Terms of Service

Welcome to VAGO Atelier. These Terms of Service ("Terms") govern your use of the VAGO Atelier mobile application (the "App") and the VAGO Atelier website at www.vagoatelier.com (the "Website"), collectively referred to as our "Services," operated by VAGO Atelier("we," "our," or "us"). By downloading, installing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

To access certain features of the App, you must create an account using Google or Facebook sign-in. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Providing accurate and up-to-date information
  • Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

3. Products and Pricing

  • All products listed on the App are subject to availability. We reserve the right to discontinue any product at any time.
  • Prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated.
  • We make every effort to display accurate pricing. In the event of a pricing error, we reserve the right to cancel orders placed at incorrect prices and notify you of the cancellation.
  • Product images are for illustrative purposes. Actual products may vary slightly in colour, texture, or appearance due to photography, screen settings, or handcrafted nature of the items.

4. Orders and Payments

  • Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order.
  • Once an order is confirmed, you will receive a confirmation notification with your order details.
  • Payment must be completed at the time of order placement through the available payment methods.
  • We are not responsible for any additional charges imposed by your bank or payment provider.

5. Shipping and Delivery

  • We deliver across India. Delivery timelines are estimates and may vary based on your location and product availability.
  • You are responsible for providing a complete and accurate delivery address. We are not liable for failed deliveries due to incorrect address information.
  • Risk of loss and title for products pass to you upon delivery to the specified address.

6. Returns and Refunds

Our returns and refunds are governed by our Refund & Return Policy. Please review it carefully before making a purchase.

7. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Impersonate any person or entity
  • Interfere with or disrupt the App's functionality
  • Attempt to gain unauthorised access to our systems
  • Use automated tools to scrape, crawl, or extract data from the App
  • Submit false or misleading information
  • Engage in any activity that could harm other users or our business

8. Technology Infrastructure

Our Services are developed and maintained by Sinlung Tech, our technology infrastructure partner. By using our Services, you acknowledge that data collected through your use of our Services — including account information, transactional data, and usage data — is managed and processed through Sinlung Tech's infrastructure. Sinlung Tech's handling of your data is governed by their own privacy policy.

9. Intellectual Property

All content on the App — including but not limited to text, graphics, logos, images, product descriptions, and software — is the property of VAGO Atelier or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

10. Disclaimer of Warranties

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAGO ATELIER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless VAGO Atelier, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. You may also delete your account at any time through the App or by contacting us.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in India.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice in the App. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
